The Socialist Party (PS) and the Social Democratic Party (PSD) were ordered to pay a fine of 10,000 euros each for the unauthorized use of the song “Despacito” by Puerto Rican artist Luís Fonsi, “TSF” radio said. this friday.
The Lisbon Court of Appeal upheld the ruling of the Intellectual Property Court which ordered both parties to pay the fine to the Portuguese Authors Society.
The song was adapted for the campaign hymns of the PS candidate for the Vila Pouca de Aguiar Chamber and the PSD for Póvoa de Lanhoso, in the last local elections. The parties attempted to demarcate their responsibilities, claiming that they were municipal candidacies, but the argument was not considered by either court.
The PS, sentenced at first instance to pay 10,000 euros, said it warned the council as soon as it was alerted by the Portuguese Society of Authors, who even contacted the parties to ask for payment of rights to music.
In the case of the PSD, the party noted that the campaign is locally defined and warned the councils of the “need for scrupulous compliance with the copyright regime”.
